Cancellation and Refund Policy

GENERAL:

1. If you place an order electronically via the website you are using, you are considered to have accepted the pre-information form and the distance sales contract presented to you.

2. Buyers are subject to the provisions of the Law on Consumer Protection No. 6502 and the Regulation on Distance Contracts (RG:27.11.2014/29188) and other applicable laws regarding the sale and delivery of the purchased product.

3. Shipment costs, which are the shipping charges, will be paid by the buyers.

4. Each product purchased is delivered to the person and/or organization at the address indicated by the buyer, provided that it does not exceed the 30-day legal period. If the product is not delivered within this period, Buyers may terminate the contract.

5. The purchased product must be delivered completely and in accordance with the specifications indicated in the order, and if there is any, along with documents such as a warranty certificate and user manual.

6. If it becomes impossible to sell the purchased product, the seller must notify the buyer in writing within 3 days from becoming aware of this and the total amount must be refunded to the Buyer within 14 days.

IF THE PURCHASED PRODUCT IS NOT PAID:

7. If the buyer does not pay for the product he/she has purchased or cancels it in the bank records, the Seller's obligation to deliver the product ends.

UNAUTHORIZED USE OF CREDIT CARD AND PURCHASES:

8. After the product is delivered, if it is determined that the credit card used for the payment was unfairly used by unauthorized persons and the price of the sold product is not paid to the Seller by the relevant bank or finance institution, the Buyer must return the product to the Seller within 3 days, with shipping costs to be borne by the SELLER.

IF THE PRODUCT CANNOT BE DELIVERED IN TIME DUE TO UNFORESEEN REASONS:

9. If there are unforeseen force majeure events preventing timely delivery, the situation is communicated to the Buyer. The Buyer may request cancellation of the order, replacement of the product, or postponement of delivery until the obstacle is removed. If the Buyer cancels the order; if the payment was made in cash, the amount will be returned in cash within 14 days. If the Buyer has paid by credit card and cancels it, the product price will be refunded to the bank within 14 days from the cancellation, but it may take 2-3 weeks for the bank to transfer it to the buyer's account.

THE BUYER'S OBLIGATION TO CHECK THE PRODUCT:

10. The Buyer will examine the contractual goods/services before receiving them and will not receive damaged, broken, torn, etc., goods/services from the cargo company. The received goods/services will be deemed to be intact and undamaged. The BUYER must carefully protect the goods/services after delivery. If the right of withdrawal will be used, the goods/services must not be used. The invoice must also be returned with the product.

RIGHT OF WITHDRAWAL:

11. The BUYER can reject the goods without assuming any legal or penal responsibility and may use the right of withdrawal from the contract within 14 (fourteen) days from the delivery date of the purchased product to him/herself or the person/organization at the address he/she has shown, by notifying the SELLER through the following contact details.

DURATION OF THE RIGHT OF WITHDRAWAL:

13. The 14-day period begins from the contract signing date if the product purchased is a service. The right of withdrawal cannot be used for service contracts begun with the consumer's approval before the period expires. The right of withdrawal details are provided in the Distance Contracts and Cancellation Conditions, and the Buyer is informed about these conditions when placing an order.

14. The costs arising from the exercise of the right of withdrawal belong to the SELLER.

15. It is required that a written notification is made to the SELLER via registered post, fax, email, or another method specified by the SELLER within the 14 (fourteen) day period for the use of the right of withdrawal, and the product must not be used within the framework of the provisions set out under "Products for which the Right of Withdrawal Cannot be Used" in this contract.

USAGE OF THE RIGHT OF WITHDRAWAL:

16. The invoice for the product delivered to the third party or BUYER (If the invoice of the product to be returned is corporate, it must be sent along with the return invoice issued by the institution when returning it. Refund requests for orders invoiced to institutions will not be completed without a return invoice.)

17. The return form, the box, packaging, if any, standard accessories, and the product being complete and undamaged must be delivered.

RETURN CONDITIONS:

18. The SELLER is obliged to refund the total amount and the documents that put the BUYER under debt within 10 days after the withdrawal notification reaches him/her and to take back the goods within a 20-day period.

19. If there is a decrease in the value of the goods or the return becomes impossible due to the BUYER’s fault, the BUYER must compensate the SELLER's losses at the rate of their fault. However, the BUYER is not responsible for changes and deterioration due to proper use of the goods or the product within the withdrawal period.

20. If the campaign limit amount issued by the SELLER is reduced due to the exercise of the right of withdrawal, the discount amount benefitted in the campaign is canceled.

PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE USED:

21. Products prepared in accordance with the BUYER's request or clearly personal needs and unsuitable for return, bottom parts of underwear, swimwear and bikini bottoms, makeup materials, disposable products, goods at risk of spoilage or expiring quickly, if their package is opened after delivery to the BUYER, goods that become mixed with other products after delivery and are impossible to separate due to their nature, goods related to periodicals such as newspapers and magazines, other than those provided under a subscription agreement, services instantly executed in electronic environments or intangible goods instantly delivered to the consumer, sound or image recordings, books, digital content, software programs, data recording and data storage devices, computer consumables cannot be returned if the BUYER has opened the package. In addition, contracts for services begun before the withdrawal period ends with the consumer's approval are also not eligible for withdrawal as per the Regulation.

22. Cosmetic and personal care products, underwear products, swimwear, bikinis, books, copyable software and programs, DVDs, VCDs, CDs and cassettes, and stationery consumables (toner, cartridge, ribbon, etc.) need to be unopened, untested, unspoiled, and unused for returns.

23. According to the regulation on distant contracts, the following items are not eligible for withdrawal:

  • Contracts for goods prepared according to the consumer's requests or personal needs.

  • Contracts for the delivery of goods that are perishable or may expire quickly.

  • Contracts for delivering goods whose protective elements such as packaging, tape, seal, package, etc., have been opened after delivery and are unsuitable for return for reasons of health and hygiene.

  • Contracts for goods that are mixed with other products after delivery and cannot be separated by their nature.

  • Contracts for books, digital content, and computer consumables presented in a material environment if their protective elements like packaging, tape, or seal have been opened after delivery.

  • Contracts for leisure time activities such as accommodation, furniture transport, car rental, food and beverage supply arranged for a specific date or period.

  • Contracts for services instantly executed electronically or intangible goods instantly delivered to the consumer.

DEFAULT STATUS AND LEGAL CONSEQUENCES

24. If the BUYER falls into default when making payment transactions via credit card, he/she accepts, declares, and undertakes to pay interest to the bank within the framework of the credit card contract between the cardholder and the bank and to be liable to the bank. In this case, the bank may initiate legal proceedings; it may demand the costs and attorney's fee from the BUYER, and under any circumstances, the BUYER accepts to pay the damages and losses of the SELLER arising from the delay in the performance of its debt.
